Welcome to Edocare!

This User Agreement (“Agreement”) is a legal contract between you (“User,” “you,” or “your”) and Edocare Inc., a Delaware C-Corp operated from India (“Edocare,” “we,” “us,” or “our”). By accessing or using our website, platform, or services (“Platform”), you agree to be bound by this Agreement, our Privacy Policy, and any other applicable policies or guidelines we may provide.

1. Services Provided

1.1. Platform Use: Edocare provides a digital platform that connects Users with third-party healthcare providers, including hospitals, doctors, and clinics for medical consultations, procedures, and treatments (“Medical Services”).
1.2. No Medical Advice: Edocare is not a healthcare provider and does not provide medical advice, diagnosis, treatment, or healthcare services. All Medical Services are provided exclusively by independent third-party providers (“Healthcare Providers”).
1.3. Non-Emergency Use: Our Platform is NOT intended for use during medical emergencies. If you are experiencing a medical emergency, contact emergency services immediately.


2. User Responsibilities

2.1. Eligibility: By using our Platform, you represent that you are at least 18 years of age or have obtained legal guardian consent if you are a minor.
2.2. Accurate Information: You agree to provide accurate, complete, and current information when using our Platform.
2.3. Compliance with Laws: You agree to use the Platform in compliance with all applicable laws and regulations of your home country and the destination country.
2.4. No Interference: You shall not attempt to interfere with the normal operation of the Platform or engage in fraudulent activities.


3. Payment Terms

3.1. Payment Processing: Payments for Medical Services facilitated through our Platform may be processed via third-party payment processors.
3.2. Fees and Charges: You agree to pay all applicable fees displayed at the time of booking Medical Services.
3.3. Refund Policy: Refunds and cancellations are subject to the terms of the respective Healthcare Providers. Edocare is not responsible for processing refunds unless explicitly stated.


4. Consent and Medical Services Disclaimer

4.1. Informed Consent: You are responsible for providing Informed Consent to the Healthcare Providers before undergoing any consultation, treatment, or procedure.
4.2. No Liability for Medical Services: Edocare does not endorse, verify, or guarantee the qualifications, expertise, or suitability of any Healthcare Provider. All Medical Services are provided solely by independent Healthcare Providers, and Edocare shall not be liable for any harm, injury, or adverse outcome resulting from Medical Services.


5. Intellectual Property

5.1. Ownership: All content, logos, trademarks, and other intellectual property on the Platform are the property of Edocare or its licensors.
5.2. Limited License: Edocare grants you a limited, non-exclusive, revocable license to use the Platform for personal, non-commercial purposes.


6. Limitation of Liability

6.1. Disclaimer: The Platform is provided “as-is” and “as-available.” Edocare makes no warranties, express or implied, regarding the Platform’s performance, accuracy, or availability.
6.2. Liability Limitation: To the maximum extent permitted by law, Edocare shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Platform or Medical Services.


7. Indemnification

You agree to indemnify, defend, and hold harmless Edocare, its officers, directors, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising from your misuse of the Platform, violation of this Agreement, or interactions with Healthcare Providers.


8. Modifications

Edocare reserves the right to modify or update this Agreement at any time. Any changes will be effective upon posting on the Platform. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Agreement.


9. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, United States. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with the seat of arbitration in New Delhi, India.
